ESSENTIAL FUNTIONS

STATEMENT OF PURPOSE:

The Director of Human Resources & Corporate Compliance had dual responsibilities for two critical components related to Employee Relations and Corporate Compliance.  The individual in this position will guide and manage the overall Human Resources function (e.g. services, policies, and programs for the entire company). In addition, the individual in this position will also function as the Corporate Compliance and Privacy Officer.

 The primary Human Resources areas directed are:

  • Recruiting and staffing to provide a superior workforce;
  • Performance management and improvement systems;
  • Organizational development;
  • Employment and compliance to regulatory concerns;
  • Employee orientation, development, and training;
  • Policy development and documentation;
  • Employee relations;
  • Compensation and benefits administration;
  • Employee safety, welfare, wellness and health;
  • Employee services and counseling;
  • Development of an employee-oriented company culture that emphasizes quality,   continuous improvement, and high performance.

Development of the Human Resources Department

  • Oversees the implementation of Human Resources programs through Human Resources staff. Monitors administration to established standards and procedures;
  • Identifies opportunities for improvement and resolves any discrepancies;
  • oversees and manages the work of reporting Human Resources staff. Encourages the ongoing development of the Human Resources staff;
  • Develops and monitors an annual budget that includes Human Resources services, employee recognition and administration;
  • Selects and supervises Human Resources consultants, attorneys, and training specialists, and coordinates company use of insurance brokers, insurance carriers, retirement savings plan administrators, and other outside sources;
  • Conducts a continuing study of all Human Resources policies, programs, and practices to keep management informed of new developments;
  • Leads the development of department goals, objectives, and systems;
  • Establishes departmental measurements that support the accomplishment of the organization’s strategic goals;
  • Directs the preparation and maintenance of such reports as are necessary to carry out the functions of the department. Prepares periodic reports for management, as necessary or requested, to track strategic goal accomplishment;
  • Participates in executive, management, and company staff meetings and attends other meetings and seminars.

Human Resources Information Systems HRIS

  • Manages the development and maintenance of the Human Resources sections of both the Internet, particularly recruiting, culture, and company information; and Intranet sites;
  • Defines all Human Resources training programs, and assigns the authority / responsibility of Human Resources and managers within those programs. Provides necessary education and materials to managers and employees including workshops, manuals, employee handbooks, and standardized reports;
  • Establishes an in-house employee training system that addresses company training; needs including training needs assessment, new employee orientation, or onboarding, management development, the measurement of training impact, and training transfer;
  • Assists managers with the selection and contracting of external training programs and consultants;

Employment

  • Establishes and leads the standard recruiting practices and procedures necessary to recruit and hire a superior workforce;
  • Facilitates the development of a world-class employee onboarding and orientation to include (when possible) a paperless credentialing process;
  • Collaborates with the CFO to establish and maintain cost-effective staffing models by facility;
  • Chairs any employee selection committees or meetings

Employee Relations

  • Formulates and recommends Human Resources policies and objectives for the company with regard to employee relations;
  • Partners with management to communicate Human Resources policies, procedures, programs and laws;
  • Determines and recommends employee relations practices necessary to establish a positive employer-employee relationship and promote a high level of employee morale and motivation;
  • Conducts investigations when employee complaints or concerns are brought forth
  • Monitors and advises managers and supervisors in the progressive discipline system of the company. Monitors the implementation of a performance improvement process with non-performing employees;
  • Reviews, guides, and approves management recommendations for employment terminations;
  • Monitors the tracking of OSHA-required data;
  • Reviews employee appeals through the company complaint procedure.

Compensation

  • Establishes the company wage and salary structure, pay policies, and oversees the variable pay systems within the company including bonuses and raises;
  • Leads competitive market research to establish pay practices and pay bands that help to recruit and retain superior staff;
  • Monitors all pay practices and systems for effectiveness and cost containment;
  • Participates in at least one salary survey per year.

Benefits

  • In partnership with the assistance of the CEO and CFO, obtains cost effective employee benefits; monitors national benefits environment for options and cost savings;
  • Recommends changes in benefits offered, especially new benefits aimed at employee satisfaction and retention.

Law

  • Leads company compliance with all existing governmental and labor legal and government reporting requirements including any related to the Equal Employment Opportunity (EEO), the American with Disabilities Act (ADA), the Family and Medical Leave Act (FMLA), Employee Retirement Income Security Act (ERISA), the Department of Labor, worker compensation, the Occupational Safety and Health Administration (OSHA), and so forth. Maintains minimal company exposure to lawsuits
  • Directs the preparation of information requested or required for compliance with laws. Approves all information submitted. Serves as the primary contact with the company employment law attorney and outside government agencies
  • Protects the interests of employees and the company in accordance with company Human Resources policies and governmental laws and regulations

Organization Development

  • Designs, directs, and manages a company-wide process of organizational development that addresses issues such as succession planning, superior workforce development, key employee retention, organizational design, and change management;
  • Manages employee communication and feedback through such avenues as company meetings, employee satisfaction surveys, employee focus groups, one-on-one meetings, and Intranet use;
  • Directs a process of organizational planning that evaluates company structure, job design, and personnel forecasting throughout the company. Evaluates plans and changes to plans. Makes recommendations to executive management;
  • Identifies and monitors the organizational culture so that it supports the attainment of the organization’s goals and promotes employee satisfaction;
  • Keeps the CEO and the executive team informed of significant problems that jeopardize the achievement of company goals and those that are not being addressed adequately at the line management level;

The primary Corporate Compliance Officer areas directed are:

  • Coordinate the planning, implementation and maintenance of the corporate compliance program;
  • Oversee the activities related to implementation and adherence to the organizations policies and procedures covering the privacy of and access to patient health information in compliance with federal and state laws

Additional Corporate Compliance Officer Responsibilities

  • Coordinate the development and implementation of the organization’s corporate compliance program;
  • Assist in the establishment of and function as the lead for the Compliance committee;
  • Develop and maintain standards of conduct and related policies and procedures;
  • Implement compliance training and communication for all affected parties;
  • Establish controls/audit tools for an effective compliance program and conduct on-going compliance monitoring activities;
  • Monitor corporate-wide compliance plan for periodic updates as needed;
  • Establish reporting channels (e.g. Ethics Point Hotline) for use without fear of retaliation;
  • Coordinate and conduct investigations to resolve compliance issues;
  • Respond appropriately, if violations are uncovered, internally and externally;
  • Provide on-going compliance training to the CEO and appropriate Board level committee as required;
  • Maintain a working knowledge of relevant issues, laws and regulations.

 Company Privacy Officer Responsibilities

  • Provide development guidance and assist in the identification, implementation and maintenance of the organization’s information privacy policies and procedures.
  • Assist in the establishment of and function as the lead for the HIPAA Compliance Committee.
  • Perform initial and periodic information, privacy risk assessments and conduct related ongoing compliance monitoring activities.
  • Ensure the organization has and maintains appropriate privacy and confidentiality notices and materials reflecting current organizational practices and requirements.
  • Implement privacy/confidentiality training for all affected parties.
  • Participate in the on-going compliance monitoring of all trading partners and business associate agreements to ensure privacy concerns and requirements are addressed.
  • Establish a reporting system for complaints concerning the organization’s privacy policies and procedures. Ensure consistent application of sanctions for failure to comply with privacy policies for all individuals in the organization’s workforce.
  • Maintain a working knowledge of relevant issues, laws and regulations.
  • Comply with all facility policies and procedures including, but not limited to those addressing HIPAA and Compliance.
  • Participate in in-service/education regarding Quality Improvement.
